1. Definitions

• Processing Order Email: The email sent to a customer confirming that their order is being prepared for fulfillment. Once this email is sent, orders are considered final and no refunds will be issued.
• Fraudulent Activity: Any act intended to deceive, manipulate, or gain unauthorized benefits, including but not limited to unauthorized chargebacks, payment fraud, impersonation, or misuse of promotional offers.
• User-Generated Content: Any content (including text, images, videos, and reviews) submitted by a customer to the website, which may be used by Complex Carbon Co. for marketing or promotional purposes.
• Backordered Product: A product that is temporarily out of stock but available for future fulfillment. Customers may request a refund only before the processing order email is sent.
• Merchandise: Any physical goods, products, or items sold or offered by Complex Carbon Co., including but not limited to skincare, personal care, and related accessories.
• Service: Any non-physical offerings provided by Complex Carbon Co., including but not limited to consultations, digital content, customer support, and order processing.

2. Customer Privacy Customer information is strictly used for the following purposes:

• To complete the sale of merchandise and ship products to the given location.
• To send newsletters, only with customer authorization.
• Essential cookies are used for website functionality.
• Shared strictly with partners serving website functionality.
• We NEVER sell any customer information to third parties.
• We implement industry-standard security measures to protect customer data from unauthorized access, loss, or misuse.
• We comply with applicable data protection laws, including GDPR (General Data Protection Regulation) and CCPA (California Consumer Privacy Act), where applicable.

• Chargebacks initiated fraudulently will be contested, and customers engaging in payment fraud will be blacklisted.
• If you enroll in a subscription service, you authorize us to charge your payment method at the start of each billing cycle. You may cancel auto-renewal at any time before the next charge. Refunds will not be issued for unused subscription periods.

5. Refund Policy

• Damaged, lost, manufacturing errors, or handling errors that are reported within 30 days of receiving the package or expected delivery date may receive a refund.
• Orders that cannot be delivered due to customer non-compliance with local laws, import regulations, or restrictions will not be refunded. It is the customer's responsibility to ensure compliance before placing an order.
• Refunds will not be issued for dissatisfaction with product effectiveness, as results may vary between individuals.
• Shipping costs are non-refundable.

6. Return Policy

• We do not accept returns in any circumstance.
• If an incorrect product was received due to our error, we will replace it at no additional cost.

7. Backordered Products

• If a product is backordered and has not yet been processed, customers may request a refund before the processing order email is sent.
• Once the processing order email has been sent, the order is final, and no refunds will be issued.

• Shipping delays caused by customs are beyond our control and do not qualify for refunds.

• Products are intended for personal use only and must not be redistributed in bulk without prior written consent.
• Customers are responsible for ensuring that our products comply with local regulations in their region.

• Our website should never be used or copied for commercial use.
• Every image and phrase on the website should not be copied or used for commercial use.
• The website should be used exclusively as a marketplace to purchase our products and learn about our company.
• Unauthorized access, data scraping, or attempts to manipulate website content are strictly prohibited.
• Any fraudulent activity, including chargebacks made without valid claims, will result in legal action.

11. User-Generated Content

• By submitting content to our website (including reviews, photos, and testimonials), you grant us a royalty-free, perpetual, and non-exclusive license to use, modify, and distribute such content for marketing and promotional purposes.

12. Liability

• Complex Carbon Co. & Associates cannot be held liable for any adverse health effects caused by negligence or improper use of the product. Refer to the instructions printed on each product.
• If the product has been damaged and is no longer legible, we are not liable for any negligence in following the posted directions. The customer is responsible for requesting a replacement and is liable for any misuse.
• Complex Carbon Co. is not liable for any allergic reactions customers may have from the use of our products.
• Customers assume full responsibility for verifying the compatibility of our products with their own skin and health conditions before use.
• Under no circumstances shall Complex Carbon Co. be liable for any indirect, incidental, or consequential damages, including but not limited to lost profits or business interruptions arising from the use of our products or website.
• We are not responsible for failures, delays, or errors caused by third-party service providers, including but not limited to shipping carriers, payment processors, and website hosting platforms. Any disputes regarding such services must be handled directly with the respective third party.

13. Compliance with Local Laws

• Customers are responsible for ensuring that the purchase and use of our products comply with local laws. We are not responsible for product restrictions in certain regions.

14. Dispute Resolution

• Any disputes arising from these Terms and Conditions shall first be attempted to be resolved through mediation.
• If mediation is unsuccessful, disputes shall be settled through binding arbitration administered by the American Arbitration Association (AAA) at its Seattle Regional Office, located at 1420 Fifth Avenue, Suite 2200, Seattle, WA 98101. The arbitration shall be conducted in accordance with AAA’s Commercial Arbitration Rules. The decision of the arbitrator shall be final and binding on both parties.
• By agreeing to these terms, the customer waives their right to a class-action lawsuit against Complex Carbon Co. and agrees that all disputes shall be handled on an individual basis.

15. Governing Law

• These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes that require legal action shall be resolved through arbitration as outlined in Section 14. If arbitration is deemed unenforceable for any reason, disputes shall be settled in the state or federal courts located in the state of Washington. 

16. Changes to Terms

• We reserve the right to update these Terms and Conditions at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of the revised terms.
• Customers are responsible for reviewing these terms periodically to stay informed of updates.

17. Intellectual Property 

• All content on this website, including but not limited to text, images, branding, and product designs, is the exclusive property of Complex Carbon Co. Unauthorized reproduction, distribution, or modification of any content is strictly prohibited and may result in legal action.

18. Force Majeure 

• We shall not be held responsible for delays or failure in performance due to circumstances beyond our control, including but not limited to natural disasters, acts of war, supply chain disruptions, or governmental restrictions.

19. Servability
